Today we explore one of the four freedoms of the European Union: the freedom of establishment and providing services in another Member State.

Les principes fondamentaux régissant la liberté d’établissement et la libre prestation de services sont contenus dans le Traité sur l’Union européenne, tandis que leur régime est précisé tant par les directives européennes que par la jurisprudence de la Cour de justice de l’Union européenne.

The fundamental principles governing the freedom of establishment and the freedom to provide services are contained in the Treaty on European Union, while their regime is specified both by European directives and by the case law of the Court of Justice of the Union European.

L’arrêt Reyners de la Cour de justice de l’Union européenne (1974) concerne la liberté d’établissement. Il est possible d’exercer la profession d’avocat dans Etat membre autre que celui de sa nationalité.

The Reyners judgment of the Court of Justice of the European Union (1974) concerns the freedom of establishment. It is possible to practice the profession of lawyer in a Member State other than that of one’s nationality.

L’arrêt Van Binsbergen (1974) traite de la libre prestation de services. Les personnes ont le droit d’exercer les fonctions de conseil juridiques dans un autre Etat membre. Cet arrêt contient une obligation de résultat précise visant à s’assurer de l’absence de discrimination envers un prestataire n’ayant pas de résidence dans le pays de la prestation de services.

The Van Binsbergen judgment (1974) deals with the freedom to provide services. Individuals have the right to exercise the functions of legal counsel in another Member State. This judgment contains a specific obligation of result aimed at ensuring that there is no discrimination against a provider who does not have a residence in the country where the services are provided.

La liberté d’établissement entraîne le droit de s’établir à titre principal ou secondaire sur le territoire des autres Etats membres, pour les personnes physiques et les personnes morales.

The freedom of establishment entails the right to establish, on a primary or secondary basis, in the territory of other Member States, for natural and legal persons.

Or parfois le droit des pays d’origine peut dissuader d’exercer la liberté d’établissement (voir les arrêts Sevic et Marks & Spencer de 2005).

However, sometimes the law of the country of origin can dissuade from exercising the freedom of establishment (see the Sevic and Marks & Spencer judgments of 2005).
